4.1 Listings

• • Providers must present truthful, up-to-date information (qualifications, insurance/licences where required, age/skill requirements, venue details, child safety notes, and policies).
• • Providers must obtain all necessary permissions to use premises, materials, and any child imagery (explicit parental consent required where a child can be identified).

4.2 Bookings

• • A Booking is formed when a Parent completes the booking flow and receives confirmation. Some Listings may require Provider approval before confirmation.
• • Parents are responsible for ensuring the Student meets prerequisites and attends on time with appropriate equipment/attire.

4.3 Payments

• • All prices are displayed in Indian Rupees (INR/₹) unless stated otherwise.
• • Payments may be collected via UPI and cards through our RBI regulated payment partners. We do not store full card/UPI credentials.
• • Prices are set by Providers unless otherwise stated. GST and any applicable convenience/service fees will be shown at checkout.
• • Where we act as an e-commerce operator, we may be required to deduct/collect: (a) TDS under Section 194 O of the Income Tax Act and (b) TCS under Section 52 of the CGST Act on eligible transactions.

4.4 Cancellations & Refunds

• • Each Listing includes the applicable cancellation/refund policy set by the Provider and/or the Platform. Please review before booking.
• • Where a refund is due, it will be processed to the original payment method subject to payment processor timelines and our/Provider policies.
• • If a Provider cancels or materially changes an activity, Parents may be entitled to a refund or rebooking, in accordance with the applicable policy.

4.5 No Circumvention

Parental supervision:

Parents remain responsible for the supervision, transport, punctual drop-off/pick-up, health disclosures, and overall welfare of the Student.

Health & access needs:

Parents must disclose relevant health, allergy, medical, or access needs that are necessary for safe participation. Providers must handle such information confidentially and solely for safety.

Provider obligations:

1. Maintain safe premises/equipment; follow child-safeguarding, first-aid, and emergency protocols.
2. Ensure staff background checks/ID, training, and required licences/permits.
3. Display accurate listing info (eligibility, risks, gear required).
4. Obtain explicit parental consent for any identifiable photos/videos.
5. Providers must keep Public Liability and, where relevant, Professional Indemnity and Personal Accident cover.
6. Ensure immediate first aid and appropriate escalation.
7. Notify parents/guardians and MyKidsRadius at the earliest in case of any incident.
8. Preserve relevant records/CCTV/equipment whenever necessary.
9. Cooperate with authorities and MyKidsRadius's review.
10. MyKidsRadius may suspend affected listings during review.
11. Provider agrees to defend, indemnify, and hold harmless MyKidsRadius from claims arising from Provider's listings, premises, personnel, or services.

11) Disclaimers

• • As is / As available: The Services are provided on an "as is" and "as available" basis.
• • No warranties: To the fullest extent permitted by law, we disclaim all warranties, express or implied.
• • Activities risk: Participation in activities may involve risks. Parents are responsible for assessing suitability. Providers are responsible for safe delivery.

12) Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for indirect, incidental, special, consequential, or punitive damages; or aggregate liability exceeding the total fees you paid to us in the 12 months preceding the claim.

Nothing in these Terms limits liability that cannot be excluded by law (e.g., for death or personal injury resulting from negligence, fraud, or fraudulent misrepresentation).
